An Offer Letter in the UAE acts as an initial agreement between the employer and employee. It is offered by the employer to the potential employee. And officially indicates a job offer by the employer to the employee.

Offer letters differ from appointment letters as per the UAE labor law. The offer letter is an initial proposal by the employer to the new employee, laying out basic employment terms. However, it is not legally binding.

Appointment letters are employment contracts that legally bind the employee to the employer under MOHRE’s regulations. This is offered once the job offer letter is accepted, signed, and returned to the employer.

The prospective employee must accept and sign both the Offer Letter and the Appointment Letter or Employment Contract to officially get the job. And follow it up with a joining letter, which is the new employee’s acknowledgement of starting their duties with the company.

What Should a UAE Offer Letter Include?

An UAE Offer Letter includes details and clauses prescribed by MOHRE. Since 2016, the MOHRE has required employers to create offer letters in a prescribed format.

Mandatory Details

The UAE Labor Law requires employers to include certain mandatory details in the offer letters. These details are primarily identity- and basic job-information-based.

  • Employer name & license number: This detail should be mentioned in the opening section of the job offer letter.
  • Employee name & passport details: The employee’s name and their identification details should be mentioned at the very top, following the letterhead details.
  • Job title & job category: The newly hired employee’s designation and job category should be mentioned in the first paragraph.
  • Salary breakdown (basic + allowances): Following the job designation information, the letter should detail the salary, with a component breakdown.
  • Work location & working hours: To help new hires understand how much time they have to give and from where, the working hours and job location should also be mentioned.

Important Clauses

Though the employment contract details the terms and conditions of the job, the offer letter should also list key terms related to the job. This helps the employee get an idea of what is the minimum expected of them.

  • Probation period: The offer letter should mention the six-month probation period before job confirmation.
  • Offer validity & expiry date: The employer must inform the potential employee by what date they must sign, accept, and return a copy of the offer letter.
  • Visa sponsorship details: In the case of expatriates, the Visa Sponsorship-related clause is mandatory.
  • Conditions precedent: The offer letter should also mention any medical or background check that the new employee must go through before onboarding.

Is an Offer Letter Mandatory in the UAE?

Yes, employers in the UAE, whether on the Mainland or in a Free Zone, need to issue job offer letters to prospective employees as an official document of final selection. Though it does not mean the employment is finalized.

The offer letter should be issued before the MOHRE or MOL-prescribed employment contract. For expatriates, it must be sent before the work permit or visa is issued.

Please note that an MOHRE Offer Letter, unlike a company offer letter, is issued through MOHRE for Mainland employees. This document is legally binding, and employers must follow its terms. If there’s any difference between the two, the MOHRE Offer Letter takes priority.

Free Zone companies are regulated by their respective Free Zone Authorities. Each zone has its own employment rules. Instead of an MOHRE Offer Letter, employees receive a Free Zone Offer Letter, and disputes are settled within the Free Zone’s legal system.

What Are the Offer Letter Validity and Expiry Rules in the UAE?

The UAE Labour Law (Federal Decree-Law No. 33 of 2021) 2025-26 lays out the offer letter rules, including validity and expiry. The rules of offer letters are similar for nationals and expatriates. The only difference is the work permit, which comes after the job offer letter in the case of an expatriate.

For expatriates, their job offer remains valid till the expiry of their work permit. Which is two years. However, when hiring locals, employers usually allow no more than 30 days to accept and return an offer letter.

So, offer letters must be signed by both sides and submitted to MOHRE before getting approval. And when hiring an expatriate, the offer remains valid till work permit expires.

Please note that, as per the Ministerial Decree No. 46 of 2022, all employers hiring for the mainland UAE must use the standard contract format approved by Mohre when applying for a work permit. Also, Administrative Resolution No. 38 of 2022 requires employers to use standard MOHRE e-forms for work permits, offer letters, and employment contracts.

What Is the 3000 Dirham Rule?

This rule recommends travellers to carry a certain amount of money with them when they arrive in the UAE. The rule helps ensure that people coming to the UAE have enough money to support themselves. Especially when going through a visa or immigration process.

According to Article (8) of the Federal Decree by Law No. (33) of 2021, the employment contract should be based on the offer letter signed by both parties and submitted to MoHRE. So there cannot be a mismatch in salary mentioned in the offer letter and employment contract. Unless it is consented to by the new employee. 

Also, employers can’t change or replace terms mentioned in offer letters, unless:

  • The new hire’s rights are not undermined
  • Both parties agree to the changes
  • MoHRE approves the changes

How to Check if an Offer Letter Is Genuine in the UAE?

Employees can verify both the job offer and the legitimacy of the employer through MOHRE. Remember, all employers must register and use a contract form approved by MOHRE when applying for a work permit.

If you are outside the UAE and have received a job offer, you can check with the UAE embassy in your country. Or, you can also verify your job offer using MOHRE’s online enquiry service.

You’ll need to go to www.mohre.gov.ae. The, you will enter the required information, like the Transaction Number, Company Number, From – To Date, Permit Type, etc. Finally, the system will display the offer letter if it is officially registered with MOHRE.

Can a Company Reject After an Offer Letter in the UAE?

Yes, a company can retract an offer letter even after extending it to the potential hire. That is because the offer letter is an official notice from the employer to the prospective employee that they have been selected for the role.

However, as it’s not a ‘legally binding’ MOHRE employment contract letter, the employee cannot take any legal action against the employer. Only an employment contract prescribed and approved by the MOL, under the MOHRE format, ‘legally’ initiates an employment relation.

What Are the Differences Between Offer Letter and Employment Contract In the UAE?

The offer letter is the official document that extends a potential employment relationship between the employer and employee. The employment contract, which comes after the acceptance of the offer letter, legally and officially begins the relationship.
